1.Design Services:
1.1 The following Terms and Conditions of Service apply to all products and services provided by Bex Taylor Design and in the event of any dispute are governed by the laws of England and Wales.
1.2 Copyright is retained by Bex Taylor Design on all design work including vectors, ideas, visuals and illustrations created by Bex Taylor Design unless specifically released in writing and after all costs have been settled. Meaning you may not claim any design work as your own nor must you resell or redistribute. Please consult the “My Process” page for a breakdown of how your order will be generated.
1.3 If a choice of designs is presented and one is chosen for your project, only that design is deemed to be given by Bex Taylor Design as fulfilling the contract. All other designs remain the property of Bex Taylor Design, unless specifically agreed upon in writing.
1.4 Charges for design services provided by Bex Taylor Design will be set out in a written estimate or quotation that is provided to the client. At the time of the client’s acceptance of this estimate or quotation, indicating acceptance of the terms of Service, a non-refundable payment of fifty percent (50%) of the fee will become due.
1.5 This fee must be paid before the work commences or is supplied to the Client for review. The remaining fifty percent (50%) of the project quotation total will be due upon completion of the work prior to any work being released to the client. If the client wishes to pay the total amount in one payment, they may do this.
1.6 If the client requires printing and postage services, this fee will also be discussed (see paragraph 2 for print services)
Bex Taylor Design can supply .JPEG, .PNG including a transparent background, or PDF files appropriate for print upon request at no extra cost to the client if they wish to use their own printer services.
1.7 Quotation for the design work does not cover the release of any copyright design source files, including but not restricted to .indd, .psd, .ai, .png, .fla or other source files or raw code. Should the Client require these files for transfer to an in-house or other designer, they will be subject to a separate quotation or ‘buy-out’ charge to purchase said copyright which will be negotiated at the time.
1.8 Any additional services requested during the duration of project that are over and above the estimated time or monetary quotation, will become fully payable (100% of the quoted amount) at the time of request. Unless communicated by Bex Taylor Design.
1.9 The client will receive an invoice, of the quoted amount, prior to starting the project upon request. The client will have the option to do partial payments towards this invoice, of which fifty percent (50%) at least, must be paid before any work can commence. This must be paid within 14 days.
1.10 Any invoice queries must be submitted within 14 days of the invoice date.
Payment by cheque is not accepted. Suitable forms of payment are via PayPal or Bank Transfer.
1.11 By supplying text, images and other data to Bex Taylor Design for inclusion in the client’s project; the client declares that they hold the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client, or rightful copyright or trademark owner.
1.12 Any artwork, images, or text supplied and/or designed by Bex Taylor Design on behalf of the client, will remain the property of Bex Taylor Design unless otherwise agreed in writing. Complete logo copyright for print release, however they wish, is transferred to the client, not including reselling the design for their own monetary gain.
1.13 Regarding marketing and educational design, a licence for print release is granted to the client solely for the project defined in the scope or request and not for any other purpose. The client may not claim they are the creator of the work.
1.14 By agreeing to these terms, the client also agrees to having written text somewhere on the product declaring this was “Designed by Bex Taylor Design”. If printing services are also utilised, this written declaration will also include “and Printed” within if Bex Taylor design has facilitated in the printing process. This is only applicable to advertising material.
1.15 Bex Taylor Design can refuse service for any reason at all.
1.16 All artwork created by Bex Taylor Design is not permitted to be used for the training AI’s and ML models and cannot be used in conjunction with any AI’s or ML models under any circumstances.
1.17 Once completing and receiving the commissioned artwork, only Bex Taylor Design is permitted to edit the artwork for the purpose of advertising. No one else is permitted to claim they have created the artwork.
1.18 By commissioning Bex Taylor Design, the client gives permission for their artwork to be used for promotional advertising and portfolio work. Unless discussed otherwise and a formal contract has been signed by all parties concerned.
2. Printing Services:
2.1 If you are supplying your own artwork, you agree that your artwork:
2.1 (a) Is accurate (where facts are provided)
2.1 (b) Is not defamatory or inflammatory of any persons or business
2.1 (c) Is compliant with the laws of England and Wales as well any other country it has been created in
2.1 (d) Is not obscene, offensive, or hateful
2.1 (e) Does not promote discrimination based on sex, race, nationality, religion, disability, age, or sexual orientation
2.1 (f) Does not promote sexually explicit material
2.1 (g) Does not infringe on any intellectual property right from any third party. Bex Taylor Design reserves the right to disclose any third party material, provided by you, to the rightful parties who property is being used.
2.1 (h) Does not promote any illegal activity
2.1 (i) Is not in contempt of court
2.1 (j) Is not threatening, abusive, or invasive of a persons privacy
2.1 (j) Does not cause unnecessary annoyance, inconvenience, or needless anxiety.
2.1 (k) Is not likely to cause upset, embarrassment, alarm, or the feeling of harassment
2.1 (l) Does not promote, incite, or advocate any party or person to commit or assist in unlawful or criminal act, by example, copyright infringement
2.1 (m) Does not incite a party or persons to contemplate and/or commit the taking or their or someone else’s life.
2.1 (n) Does not impersonate any person or misrepresent your own identity or affiliation with said person.
2.1 (o) Does not contain any statements which you know or believe or have reasonable grounds for believing that members of the public would interpret to be that of preparation, instigation, or acts of terrorism
2.1 (p) Has a second copy that you have retained as Bex Taylor Design is not responsible for any lost or corrupted files
2.1 (q) Has been fully spellchecked by you or someone you trust as Bex Taylor Design is not responsible for any spelling or information errors
2.1 (r) Bex Taylor Design reserves the right to amend price quotes upon reorder in keeping with the changing market prices. Any quotes given before price changes will be honoured for 30 days. If not acted upon before those 30 days the the new prices will take effect.
2.1 (s) By supplying Bex Taylor Design with your artwork, not created by Bex Taylor Design, you will not transfer any ownership to Bex Taylor Design. You shall retain full ownership of your artwork.
2.2 If you are using designs created by Bex Taylor Design, you will be informed if any of your design requests conflict with the stipulations above.
3. Approving artwork:
3.1 Prior to sending your artwork, wether created by Bex Taylor Design or by an external source, an electronic proof will be created upon full payment for the goods. It is your responsibility to check this proof carefully and approve it for print.
3.2 You accept that by giving your own approval the artwork cannot be changed or cancelled. Bex Taylor Design is not responsible for any errors in the artwork after approval by you. If there is an issue with the stock or product, this will be challenged with the supplier on your behalf by Bex Taylor Design.
3.3 Your statutory rights are not excluded, limited, or affected in any way by these terms and conditions
4. Delivery:
4.1 Your products will be despatched for delivery in accordance to the delivery service you have chosen during the ordering process.
4.2 International delivery is not available at this time.
4.3 Dispatch timescales are dependant on what products have been order and what the supplier is able to fulfil.
4.4 Your order will be delivered by DPD, which can be sent on Next Day Delivery excluding Inverness, Highlands, Northern Ireland, Isle of Man, Isle of Wight, Paisley, and Aberdeen which is on a two day service. Turnaround dates are an estimated and cannot be guaranteed.
4.5 All products will require a signature upon delivery. If delivery is unsuccessful for any reason, such as lack of signature, wrong delivery address provided, or refusal of order, the the products will be returned to the supplied where they will hold them for five(5) days. An additional delivery charge may be charged by the supplier which you will be liable for. Failure to pay this will result in your products not being delivered. This re-dispatch must be requested within five(5) working days, failure to do so may result in your order being recycled and a new order must be placed and paid for if the products are still required.
4.6 Working days are Monday to Friday excluding UK Bank Holidays
4.7 If the product is delivered to the wrong address and is signed for, Bex Taylor Design is not liable for this as the product was delivered to the correct address provided. Delivery is completed one the products have been unloaded at the address provided by yourself.
4.8 If delivery is delayed by exceptional circumstances or a Force of Majeure Event. The delivery will be processed by the supplier, upon their discretion, as soon as reasonably possible.
4.9 You must notify Bex Taylor Design within 20 days of the date that the products were dispatched for any failure, on the suppliers part, in order for the supplier to have time to investigate the matter and take appropriate action.
5. Quantities:
5.1 Bex Taylor Design is not liable for insufficient quantities delivered. However, the suppliers acknowledge there may be variations and hold liability in respect of shortages which are as follows:

5.2 You must contact Bex Taylor Design within 5 working days of any shortage issues in order to allow time for Bex Taylor Design to contact the supplier to arrange a refund or re-print.
5.3 By placing an order with Bex Taylor Design either through design or print, you agree to these terms of service. This is done in lieu of any contract, however, if you wish to have a contract written up, please inform Bex Taylor Design before exchange of any funds
